The Gentle Sleep Specialist does not make any representations or warranties, express or implied, regarding the Services. The Gentle Sleep Specialist is not liable for any loss, damage, injury, liability, cost or expense of any nature arising from, or related to, the Services.   Where the law implies into this agreement any obligation, condition or warranty that cannot be restricted or modified, the liability of the Gentle Sleep Specialist for any breach of such obligation, condition or warranty in the provision of the Services will (to the full extent permitted by law) be limited to, at our sole option, repayment of any part of the price of the Services supplied. 

Terms & Conditions for Packages.

These terms and conditions apply to the supply of the Services by The Gentle Sleep Specialist to the Client.

As a participant in The Gentle Sleep Specialist program, the Client is expected and encouraged to always follow SIDS safe guidelines.  Those guidelines are accessible here:  Red Nose Six Safe Sleep Recommendations | Red Nose Australia

  1. All consultation/online fees must be paid prior to commencement of initial consult and/ or joining the program. The Gentle Sleep Specialist reserves the right to postpone and/ or cancel a consultation if payment is not made.
  2. It is the responsibility of the client to consult with a qualified medical professional before commencing the program, particularly if they or their child have a current or prior medical condition, including but not limited to sleep disorders, developmental concerns, neurological conditions, or any other health-related issues. By enrolling in this program, the client acknowledges that they have obtained, or will obtain, appropriate medical clearance where necessary. The Gentle Sleep Specialist and its representatives accept no liability for any outcomes that arise from the failure to disclose relevant medical conditions or seek appropriate medical advice prior to participation.
  3. One on One consultation packages: If the client chooses not to proceed after the initial consult and notifies of their intention to discontinue in writing prior to receiving the emailed plan, the client is eligible for a 20% refund on the initial sum paid for the package.
  4. You will have 4 months maximum after your initial consult to begin your follow up two weeks of calls. Should you not proceed within that time period all refunds will be void unless communicated otherwise with Sam or Tara. 
  5. One on One consultation packages: If the client chooses not to proceed after the initial consult and notifies of their intention to discontinue in writing after the plan has been emailed to the Client or at any stage during the first week follow up period, the client is eligible for a 10% refund of the initial payment for the package.
  6. One on One consultation packages: If the Client chooses not to proceed during the final week of follow up, no refund will be given.
  7. If the Client chooses to cancel within 24 hours of the scheduled time of the initial consult, the Client will be eligible for refund and a $55.00 late cancellation fee will be deducted from the eligible refund.
  8. Every child is different. Whilst the program has delivered successful outcomes for many families, the program may not be suitable for all children and results may vary.   Medical advice should be obtained prior to commencing any sleep program to diagnosis potential medical conditions that may be causing sleep disruption.  The Gentle Sleep Specialist takes no responsibility for the results of the program and the program is not a substitute for medical advice or treatment.
  9. If the Client becomes uncooperative, threatening, or if there is reason to believe that a parent is not taking reasonable steps to ensure the care and safety of the child (to be determined in the sole discretion of the Gentle Sleep Specialist), The Gentle Sleep Specialist reserves the right to terminate the Services without refund.
  10. The Gentle Sleep Specialist complies with mandatory reporting laws. If, during the supply of Services, the Gentle Sleep Specialists forms a reasonable belief of child physical or sexual abuse it will be reported to child protection authorities as required by law.
  11. The Gentle Sleep Specialist’s packages include once-daily follow up phone calls initiated by Tara Mitchell or her nominated representative agreed with the Client. Reasonable attempts will be made each day to make contact, however if the Client is not answering the phone, The Gentle Sleep Specialist is not responsible, and no refund or substitute service will be provided.
  12. During the two weeks follow up, The Gentle Sleep Specialist may choose to send follow-up SMS text messages in place of a phone call if the Client and the child are doing well.
  13. If you are an international Client, phone follow up will usually be replaced with Skype arrangements and SMS text messages on every second day.
  14. As a participant in The Gentle Sleep Specialist program, the Client is expected and encouraged to always follow SIDS safe guidelines. Those guidelines are accessible here:  Red Nose Six Safe Sleep Recommendations | Red Nose Australia
  15. If the Client needs to put the program on hold after commencement of the program, arrangements will be at the discretion of The Gentle Sleep Specialist, to be agreed in writing with the Client. 
  16. The Client acknowledges that aspects of the program include controlled crying.  There is no obligation on a Client to continue the program, however, refunds remain as stated above.

Definitions:

“The Gentle Sleep Specialist”: Tara Emma Mitchell, or any employee or contractor of The Gentle Sleep Specialist.

“Client”: the person receiving the Services and/or information provided by the Gentle Sleep Specialist.

“Services”:  means the phone consultation package, in homes 3 hour, 5 hour, 90 min and our Online programs Baby and Toddler sleep programs, guides, app and any other information or services that may be provided by The Gentle Sleep Specialist to the Client from time to time.
